1. Scope

These Terms & Conditions apply to all purchases made by consumers (B2C) via www.elsner.li from Laura Elsner (“Provider”, “we”, “us”).
“Consumer” means a natural person acting for purposes outside their trade, business, or profession.
These Terms apply to digital products (downloads) and 1:1 services offered on our website.

3. Products and services
Digital product: Vision Template (download) You receive the digital file(s) and materials described on the sales page at the time of purchase.
1:1 services: If you purchase a 1:1 session, you receive the service described on the sales page (scope, duration, format, any included materials).

4. Ordering process and contract conclusion The product presentation on the website is an invitation to purchase.
A binding contract is concluded when you complete checkout and we confirm the order (on screen and/or by email).

5. Prices, currency, and payment
All prices are shown in EUR unless stated otherwise.
Payment is processed via PayPal. PayPal’s terms may apply.
You will receive a receipt or invoice by email or via the payment process.

6. Delivery of digital content (instant access) Digital content is delivered immediately after successful payment, typically via download link or email.
You are responsible for providing a correct email address and ensuring you can access the download (including checking spam/junk folders).
If you do not receive access within a reasonable time, contact us at [insert email].

7. Booking and delivery of 1:1 services
After purchase, you must book your 1:1 session via email by contacting contact@laura-elsner.com.
Booking window: You must book your session within 4 weeks of purchase, unless otherwise agreed in writing.
If you do not book within 4 weeks, the booking right may expire, unless we agree otherwise as a goodwill exception.

8. Rescheduling, cancellations, and no-show (1:1)
You may reschedule a booked session free of charge up to 48 hours before the scheduled start time.
Cancellations or rescheduling requests within 48 hours, or failure to attend a session (“no-show”), are treated as delivered. The session is not refunded and not replaced, unless we decide otherwise as a goodwill exception.
If we need to reschedule a session for important reasons, we will offer you an alternative date.

9. Consumer right of withdrawal (general) and digital content
Consumers may generally have a statutory right of withdrawal for distance contracts (online purchases), typically 14 days, depending on applicable consumer law.
Important for digital downloads delivered immediately: If you request immediate delivery of digital content, the right of withdrawal can be lost once delivery begins, provided that you:
- expressly request immediate performance/delivery before the withdrawal period ends, and
- acknowledge that you lose your right of withdrawal by doing so.
For this reason, we require the relevant confirmations during checkout for instant digital delivery.

10. Refund policy
No refunds: We do not offer refunds, except where mandatory consumer law requires otherwise.
For digital products delivered immediately, refunds are excluded once you have provided the required express request and acknowledgement in checkout (see section 9).
For 1:1 services, refunds are not offered for sessions that are missed or cancelled late as described in section 8, except where mandatory consumer law requires otherwise.

11. Usage rights and intellectual property (digital content)
All materials are protected by copyright and other intellectual property rights.
You receive a non-exclusive, non-transferable license for your personal use only.
You may not share, distribute, sell, sublicense, upload, publish, or otherwise make the materials available to third parties, in whole or in part.

12. Disclaimer and responsibility
Our offers are for education and personal development. They do not replace medical, psychological, or therapeutic treatment.
You remain fully responsible for your decisions, actions, and results.
We do not guarantee specific outcomes.

13. Liability
We are liable for intent and gross negligence as required by law.
For slight negligence, we are liable only for breach of essential contractual obligations and limited to typical, foreseeable damages, unless mandatory law provides otherwise.
Liability for indirect damages and consequential damages is excluded to the extent legally permitted.

14. Technical requirements
Digital products require a stable internet connection and a device/software capable of opening common file formats (for example PDF). We are not responsible for compatibility issues on your side.

15. Governing law and consumer protection note
These Terms are governed by Austrian law.
If you are a consumer, mandatory consumer protection rules of your country of residence may still apply and remain unaffected.

17. Severability
If any provision of these Terms is invalid, the remaining provisions remain effective. The invalid provision will be replaced by a valid one that best reflects the purpose of the original.
